“Content provider ” = a person who has an account to share images/videos with subscribers.

“HRN” = Hot Right Now , a leaderboard on the highest subscribed content provider

“DSL” = Devotedsubs limited ( company registration number : 13123322 ) companies house

“User” = a person who is using the website either subscriber or content provider

“CP” = Content Provider

“DM” = Direct Message

“UGC” = User Generated Content

What is Devotedsubs and what are the features (A)

DSL is a social platform for content providers to post explicit / non explicit photos and videos to connect with a following community. The viewing community can subscribe for a monthly subscription to the content providers page to view content which is produced by the content provider for a price of the content providers choice.

DSL has many features which includes a new social feature which is “Hot Right Now”. which is a monthly leaderboard on the highest 20 profiles on Devotedsubs.com

A subscriber can upgrade their subscription by clicking the devoted tab on the CP profile to stand out and have a 3 month subscription to that CP(this is only available if the CP has enabled a 3 month subscription).

DSL offers this site to the use of personnel over the age of 18 years of age , a source of ID must be used to Create a account for a subscriber/content provider. (Devotedsubs will not share/sell any personal information or any banking details with any unauthorised company’s / personnel unless approved by Devotedsubs.com and approved by User of account).

DSL has the right to change T&C from anytime, any amendment that may be changed will have to be reviewed and accepted by both subscriber and content provider. This may also include changes to:

a.) Content Providers content

b.) Changes to site

c.) Changed to profiles

d.) Changes to listings

e.) Changes to HRN

f.) Any content uploaded that is illegal or breaks the rules and T&C

DSL cannot guarantee that the site will work on every device used by a user, DSL will be compatible with the majority of devices, Devotedsubs.com will be desktop / Mobile friendly and work on most devices.

Understanding of how the website works and new features to come

DSL provides a site for an CP to upload content to make profits, a viewer will need to find an account of a CP that the viewer would like to view. The viewer will have to subscribe to a CP to view the contents on the CP’S profile, If the viewer does not subscribe to the profile, the contents of the CP will be blurred and non accessible until a purchased subscription has been made.

When a subscription has been purchased the CP will be notified that they’re profile will have a new subscriber. When this happens the site automatically updates the results of the amount of subscribers and if the CP is one of the highest 20 subscribers within that month the profile page will be featured on the HRN section on the site of DSL.

(more features will be added at a later date and automatic updates, all users will get an update notification when the new feature is available on DSL)

Use of Site (B)

Harassment in any manner or form on the site, including via Direct Message, Broadcast chat or by use of obscene or abusive language, is strictly forbidden. Impersonation of others or other licensed host, or representative, as well as other members or visitors on the site is prohibited.

You may not upload to, distribute, or otherwise publish through the site any content which is libellous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offence, violate the rights of any party or which may otherwise give rise to liability or violate any law.

You may not upload commercial content on this site or use the site to solicit others to join another organisation, this will lead to a termination of the associated account. If content is taken without permission of the content provider and shared , this is a criminal offence and actions will be taken.

By agreeing to T&C you acknowledge that the rules of the site and messages to other users cannot be used to promote similar websites, other social media platforms, to send junk Mail or chains of spam and any of the above, In this circumstance action will be taken on the account that has broken the Terms and conditions.

You may copy the link and post onto your bio on other social media websites to influence and share your profile (eg. Facebook, Instagram, Twitter, linkedin,ect.) , You cannot share your link for your profile on similar websites to DSL.

Devotedsubs follows a standard procedure of using log files. These files log visitors when they visit websites. All hosting companies do this and a part of hosting services’ analytics. Term & Termination

These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or purchase process. These terms and conditions, or any part of them, may be terminated by Devotedsubs.com without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall not survive any termination.

Termination of subscription(s)

If you want to terminate a subscription because you face reduced income or you no longer enjoy the product . You must click unsubscribe on the producers profile, if it’s for a manual subscription you will not need to unsubscribe as it is a manual subscription meaning you will have to purchase the subscription manually every month , If the subscription is purchased “accidentally“ this is not refundable a product

If a CP chooses to deactivate and remove the profile of their content, without notice , DSL will not issue any refunds to the subscriber but will stop any automatic payments to the account .

Errors within the site

In the event that a error or a bug is found from Devotedsubs.com is mistakenly listed at an incorrect price by a producer/content provider , Devotedsubs.com reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Devotedsubs.com reserves the right to refuse or cancel any such subscriptions whether or not the subscription has been confirmed and your credit card charged. A message will be issued to you on the site into regards of a subscription that is ending. Devotedsubs.com will not refund a subscription if the channel has been subscribed to manually. If any errors or Bugs are found with the site DSL please report to support@devotedsubs.com

Limitation of Liability

Devotedsubs shall not be liable for any special or consequential acts that result from the use of the site, or the inability to use, the services and products offered on this site, or the performance of the services all content provided is at the doing of a CP and is wholly the CP’s responsibility.

At any time during the use of site DSL will not be liable for any loss of earning or damages, this may occur when a subscriber decides not to follow a Content provider or a payment has not been paid for the content, the content will only be visible when paid for. DSL a platform for users to view and sell owned content, DSL does not own any of the Content Providers content but will allow users to upload Owned content. DSL will never share content between Third Party’s/Other users of the site, the content is only provided between the Content Provider and the Subscriber(s).

Participation Disclaimer

Devotedsubs does not and cannot review all communications and materials posted to or created by users accessing the site unless they are reported for review, and are not in any manner responsible for the content of these communications and materials.

You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, Devotedsubs.com is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. However, Devotedsubs.com reserves the right to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright , or other intellectual property right of another or (d) offensive or otherwise unacceptable to participation disclaimer.

User Generated Content

Devotedsubs permits the contents of video and other communications and the hosting, sharing and publishing of such users content . You understand that whether or not such User content are published and/or uploaded, Collection of Devotedsubs does not guarantee any confidentiality with respect to any submissions.

Devotedsubs allows/permits you to upload your own material on our site for personal profitable purposes only.

You shall be solely responsible for any and all of your own User Submissions and the consequences of posting, uploading and publishing them. Furthermore, with User Content , you affirm, represent and/or warrant that:

You own or retain the necessary licenses, rights, consents, and permissions to use and authorise Collection of content, secrets or other proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the Website and these Terms of Service.

You will not post, or allow anyone else to post, any material that depicts any person under the age of 18 years and you have inspected and are maintaining written documentation sufficient to confirm that all subjects of your submissions are, in fact, over the age of 18 years.

Use of the Content (as contemplated by this Agreement) will not result in payments becoming owed to any party

Nothing contained in the Content is false, inaccurate, or misleading

You will not upload any drug use / animal abuse / any firearms sales / any other sales that are for Other business(es) to promote and make sales.

You will not use the site to promote the use of any unlawful activities or any kind of escort services.

DSL strongly advised that you do not reveal an kind of identification on your content to post to the site , this can include any kind of address or address(Es) that link to you or others , we also strongly advise that you do not give out personal information either by DM or content that is visible to subscribers or content providers, this is to protect and keep you safe.

General terms for DSL and User

By agreeing to the terms for the use of the site you acknowledge that the agreement to the use of site is that the terms and conditions are abided by and that all of the terms are followed without any failure, DSL reserves the right to disable & remove content at anytime which is against the Terms.

There is no contract(s) within DSL between the Subscriber and CP and DSL, you must agree to the terms of site to use Devotedsubs.com / you will not be able to use the site if this is not accepted.

Protection of Children Act 1978 (England and Wales)

It is an offence to take, permit to be taken, make, possess, show, distribute or advertise indecent images of children in the United Kingdom. The IWF assesses content according to levels set out by the Sentencing Guidelines

Please note; it is against the law to actively seek out such images and doing Section 1 of this act, as amended by section 69 of the Criminal Justice and Immigration Act 2008, further defines indecent photographs of a child under 18 years of age to include:

A tracing or other image, whether made by electronic or other means (of whatever nature) which is not itself a photograph or pseudo-photograph, but which is derived from the whole or part of a photograph or pseudo-photograph (or a combination of either or both); and data stored on a computer disc or by other electronic means which is capable of conversion into an image within paragraph (a); and subsection (8) applies in relation to such an image as it applies in relation to a pseudo-photograph.

Section 1 of the Protection of Children Act 1978, as amended by the Criminal Justice and Public Order Act 1994, creates various offences of taking or distributing indecent photographs or pseudo-photographs of a child under 18 years of age. It states: 1(1) It is an offence for a person to take, or permit to be taken, or to make any indecent photograph or pseudo-photograph of a child; or to distribute or show such indecent photographs or pseudo-photographs; or to possess such indecent photographs or pseudo-photographs, with a view to their being distributed or shown by himself or others; or to publish or cause to be published any advertisement likely to be understood as conveying that the advertiser distributes or shows such indecent photographs or pseudo-photographs, or intends to do so.

Section 160 of The Criminal Justice Act of 1988 made the simple possession of indecent photographs of children an offence. This is an Arrestable Offence carrying a maximum sentence of 5 years imprisonment.

Making an indecent image of a child is a Serious Arrestable Offence carrying a maximum sentence of 10 years imprisonment.

With understanding and following of the Terms & Conditions Devotedsubs will give you the right to be able to post your own / owned content on Devotedsubs If the Terms and Conditions are violated or breached, DSL will have the right to remove the contents that have breached the T&C and will remove the Account with the breached content, you shall not upload content which is not owned by you, to share other pages, commercial use, Devotedsubs is a platform for users to upload personal content and for the purposes of the user.

HRN & How it works

“Hot right now” is one of the main feature of Devotedsubs, content providers can work there way up to the top of the leaderboard which is showing the highest subscribed 20 content providers in that month, meaning the highest content provider with the highest amount of subscribers will be 1. The second highest content provider will be 2. And so forth to 20. This is a monthly feature that automatically shows the highest content provider. There is no prize or winnings of being between (1.) or (20.)

Reporting a problem

If a user suspects a problem or would like to report a account or Content uploaded by a CP you can click the report button on the image or click on the users name and click the report icon, You can report user’s messages if you suspect something is wrong

Become Devoted

A user will have access to a CP profile for the price of a monthly fee as a Subscriber, if a user wants to be a noticed person the user can choose the “Devoted” option to that profile that will allow you to have a 3 month subscription at the price decided by the Content provider. The Devoted option will only be available if the Content Provider sets it up.

Deactivate / Delete account subscriber/content provider

To deactivate a account on Devotedsubs.com you must login to your account on account management, select deactivate or delete account

Content provider’s pricing & payments T&C

Content providers will receive tips from subscribers which will be 100% acquired by the content provider.

(please note, merchants fees may be deducted for fees of the payment gateway )Devotedsubs will not receive profit or any payment from tips sent by the subscriber).

A commission from a monthly subscription will be obtained by Devotedsubs (20%), the content provider will receive a majority of the subscription from a subscriber.( please note merchants fees may apply)

100% of the tip(s) on the broadcast platform will be received by the content provider (please note merchants and processing fees may apply.)

Please note a price of £4/ $5 is the minimum for a monthly subscription and the maximum price of your choice per month, the price is chosen by the content provider.

20% of a product sold via the shop will be deducted by Devotedsubs and 80% of the purchase will be sent to the content provider. ( please note merchants fees will apply )

Please note the content provider cannot ask for a payment of “Tips” for a product, all products sold by ( you ) the content provider by “direct message “ will need to be purchased by the subscriber, If you ask for tips in exchange for a product this may lead to a permanent ban on your account.

The content provider must upload one method of payment for the funds of the purchase’s / subscription payments / tips. The content provider must have personal information with via third party linked account or valid bank details linked with the content provider to allow payment to be transferred to the receiving account of payment

DSL is NOT a employer of a content providers, CPs must manage their own taxes / moneys as DSL offers a service to CP’S money from subscribers will be sent via a Third party payment system which separates payment between DSL and CP. By agreeing to the terms of DSL and registering with the website you must confirm that

you agree to these terms of use to use devotedsubs.com

all information provider on the account is all true , using false information will lead to a termination of account. Any uploaded content which is of another user or copied from another users account to put on your personal account will lead to a termination of account and legal actions against the user.

your registration to DSL is for your own personal self and not for Commercial use eg. Boosting a fake profile , uploaded copyrighted images.

you must be truthful in your previous account on DSL was banned or Terminated for breaking T&C

all payments on DSL must be purchased through the website. Any unauthorised payments through any other payment systems such as ( Third party payment) will lead into your account getting suspended

We adviseNot to use DSL on any Public devices such as libraries/ unowned devises and store personal information on a device which is not owned by the user, DSL will not take responsibility for any loss or any other loss or discovered information which is left on a public or unowned devices. ( applies to Subscribers and CP.)

if you feel as if your account is unsafe you must contact DSL on support@devotedsubs.com, DSL will review the matter and is committed to making DSL safe at all times.

Refund/subscription and purchase Policy

At Devotedsubs we have a strict policy with Refundable purchases on subscriptions and content purchases , you must read our Terms and conditions before purchasing a subscription this ensures that you agree with the T&C and that you acknowledge that you are purchasing a non refundable subscription.

If you don’t acknowledge the Terms & Conditions for purchases, please do not purchase a monthly / devoted subscription.

You are be responsible for paying for a subscription or purchasing content , you must make sure that you read our terms and conditions and to tick the box before you purchase on the checkout.

You can cancel your recurring monthly subscription at anytime by clicking at the top right of the Content Providers page ( green symbol ) to unsubscribe from the Recurring payment , if you need advice on how to stop recurring payments / subscriptions , please contact us at:

We are committed to providing a high quality service to all our Content Providers and Subscribers!. When something goes wrong, we need you to tell us about it. This will allow us to put things right for you and to help improve our service for others in the future.

If you have a complaint or an issue, please contact our user support team who will be responsible for dealing with client care issues.

On receipt of a complaint

We will acknowledge receipt of your complaint promptly.

We will ensure an senior individual investigates your complaint.

We will investigate your complaint fully and provide you with a comprehensive response including the decision arrived at as soon as reasonably practicable and in any event within 1-5 days of receipt of your complaint. If it is not possible to respond within 1-5 days you will be notified of the reasons for this and provided with a further timescale for a final response which will be no longer than 3 weeks from the date of the complaint.

If you are dissatisfied with the outcome

At this stage, if you are still not satisfied, you should contact us again and we will arrange for a Director who has not had any dealings with your matter to review the initial decision. We will write or respond via email to you within 1-5 days of receiving your request for a review.

Tax

As a CP you will receive payments for your content from subscribers, with the transactions you will need to pay tax on the payments , you are not a employee of DSL therefore you will need to pay taxes on your funds received from devotedsubs.

Subscriber T&C

Subscribers must follow and accept T&C of Devotedsubs.com, meaning if any T&C are Ignored / violated , action will be taken against the “subscriber”, this will include:

Removal of the account

b) termination of communication between the subscriber & content provider.

Subscriber interaction with content providers.

Following T&C of the site Devotedsubs. Subscribers can interact with content providers by sending “Tips” or by sending a DM to a content provider / creator as-long as the viewer has subscribed to the account that the subscriber wants to communicate with.

The subscriber must provide a payment method to be able to view the content on a CP profile and to purchase content that is sent via the CP over Direct Message.

Vat

There is no VAT for any purchases or subscription fees , please note this is applicable for now but at a later date VAT may be added , DSL will update the T&C and you will receive a email and a notification letting you know what the changes are.

Security of DSL (B)

DSL is a very secured website that is encrypted and provides the most secure information and confidentiality. Please check section 5.) and section 6.) of Content provider’s pricing & payments T&C for more information on payments and security of using a Owned device and not a public device. DSL has a SSL certification .

Delivery/Retrieval’s of goods

When purchasing a subscription from a Content Provider(s) profile the payments will be processed, all uploaded content on the content provider(s) will be instantly available to view.

Only processed payments that gone through will allow the contents to be available. To see more information about payments please see the title in our Terms and Conditions ( Refund/Subscription and Purchase policy).

Goods which can be purchased on Devotedsubs

On www.devotedsubs.com you can purchase owned content from a Content Provider, you can purchase a monthly subscription or a Devoted subscription (3 months subscription) to a Content Provider to view the content(s) uploaded by the Content Provider , This content is owned by the Content Provider , you are purchasing a monthly/ 3month subscription to ONLY view the content, you will not own the content you have paid to view for that term of your subscription.

Extra content can be added to the Content Providers “Shop” which can and will only be Photos and Videos, no physical items are purchasable only virtual.

Payments

Devotedsubs have various options of payment through a third party payment systems, meaning subscribers/ content providers will be able to pay manually or have automatic recurring payments (via credit / debit card ) per month / per 3 month(s) ( devoted plan )

DSL accepts all major credit and debit cards ( Visa , MasterCard )

DSL has no option to store money within the site meaning there is no ( Wallet / Balance ) all payments will manually need to be entered on the payment option, this makes payments more secure for both CP and Subscribers, users can set up to have a automatic subscription if wanted to a CP per month or 3 months ( devoted plan )

If you are the CP you will need to have valid bank details and a form of Identification which shows the correct address as your payment details

Accounts / username

When successfully signed up to DSL, a username will need to be created to be identified on the site of DSL, any username can be created permitted that it is not the same as another Users username or any Username that is:

a.) offensive

b.) wording such as swear / Curse wording

c). Illegal characters

Once a username is created a user cannot change a username, either a Subscriber or CP this applies for both, in order to change a username a new account will need to be created. When a account is deleted on DSL all content & Information is permanently removed and not stored for the Protection of Both Users.

You as a subscriber and CP are fully responsible for your account information, do not share your account login / passwords or Login to any personnel or Third party / companies, If DSL needs to contact you in regards to your account Login information DSL will contact you VIA email and send a notification which will show in your Notifications.

When signing up to create an account either Subscriber or Content Provider , you must provide:

1.Email address

2.a password for your account

3.The address of your residence , state and zip/post code.

When your account has been created, you can choose a username for your profile and use the username to sign in or your email.

UGC ( User Generated Content)

By consenting you agree to the UGC and you agree that posting UGC is your full responsibility and that Devotedsubs will not be responsible for any copyright or any unauthorised use of content.

A form of Identification will be required if you wish to upload Content to devotedsubs.com

This form of identification needs to be a drivers license or a passport or another form of identification which states the birth day/month/year.

You are 18 years or older and not under the age of 18

You are the creator of the Content, or are otherwise authorised to post the Content and grant the rights you are granting in this Agreement

Without limiting the above, to the extent any individual appears in your Content other than you and they are over 18 (eighteen) years of age, or any third party’s rights (for example, trademark or copyright), are included within the Content, you have obtained the permission(s) from such individual(s) and other third party/ies necessary to grant the Permitted Parties (as defined below) the rights to use the Content as contemplated by this Agreements

Without limiting the above, to the extent any individual appears in your Content other than you and they are under 18 (eighteen) years of age, we you confirm that you are the parent/guardian of that individual and consent to the use of their photographs, other visual content, audio clip and/or audio-visual content (in each case, regardless of medium or format), and their personal data, or you have obtained such consent from the parent/guardian of that individual.

The Content does not contain any advertising or other commercial content and is solely for personal use only.

Use of the Content (as contemplated by this Agreement) will not result in payments becoming owed to any party

Nothing contained in the Content is false, inaccurate, or misleading

You cannot copy, repost content , edit content which is already on the site, unless removed owned content by the user and re uploaded.

Users Indemnity

When you the user is using Devotedsubs you agree to the indemnity and hold harmless the Indemnity, its respective affiliates, employees, directors and any successors and assigns against any and all claims, losses, damages, liabilities, penalties, punitive damages, expenses, reasonable legal fees and costs of any kind or amount whatsoever, which result from the Activity of using DSL and its features and services which are as follows:

Any violation of the terms and conditions or terms of use

Any content that is uploaded and created by the user that has been published on Devotedsubs.

The use of Devotedsubs and its features or add on’s or services that Devotedsubs offers.

Governing laws

Either user agrees that the terms of the Agreement and terms and conditions shall be governed by and construed in accordance with English law and the parties must submit to the Courts of England and Wales.
